Which benefits are covered by workers’ comp?
First, medical treatments are covered. Any treatments and expenses deemed medically necessary will be paid for including surgery, physical therapy and medications. Second, workers’ comp replaces your lost wages if you are unable to work in the short term or long term. If you are permanently injured, you may be eligible for ongoing disability benefits. In the event of a work-related fatality, spouses and dependent children are entitled to death benefits under workers’ compensation.

When do benefits start?
Your medical coverage begins immediately. You should not be billed for any care related to a work accident. Wage benefits begin after you have been off the job for seven days. If your disability extends 42 or more days, you are entitled to retroactive pay for the first seven days as well.

What if my claim is denied?
You can appeal a denied claim. It may be a paperwork issue, or the insurance company may dispute whether your injury was job-related. If your claim is denied, a workers’ comp lawyer can guide you through the appeals process.

What if my treatment is denied?
If treatment is medically necessary, coverage should not be denied. But insurers are notorious for disputing expensive treatments, such as surgery. Your attorney will work with you to get you approved for the treatment you need to heal.

Can I choose my own doctor?
Nebraska workers’ compensation allows injured workers to see their own doctors for treatment. But if you do not have a regular physician, your employer will choose one of its “preferred” doctors for you.

Can I sue my employer instead of filing a workers’ comp claim?
Workers’ compensation is the “exclusive remedy.” This means you cannot sue your employer except in rare cases of willful and reckless disregard of safety regulations. In some cases, you can sue third parties such as a property owner or a manufacturer of machinery. An attorney can explore all of your possible claims.
